By enrolling in any EVO Football program, you confirm that you have read, understood, and agree to the following Terms of Service.

1. PROGRAM STRUCTURE & ENROLMENT COMMITMENT

 

1.1 Long-Term Development Model

 

EVO Football programs are long-term player development programs. Enrolment provides access to the overall coaching curriculum, coaching staff, facilities, and player development environment across the enrolment period. Program fees are not calculated on a per-session basis, and individual missed sessions do not reduce the enrolment fees payable.

Unless otherwise stated (such as PLAY Sessions, holiday programs, or short-format competitions), enrolment is for a fixed program of up to 30 weeks, typically delivered across School Terms 1, 2 and 3 in accordance with the Western Australian Department of Education term dates.

By enrolling, families acknowledge that they are committing to the full enrolment period. EVO Football recognises that genuine unforeseen circumstances may arise, such as significant injury, serious illness, or relocation. Where these circumstances occur, requests will be considered in accordance with these Terms and Conditions, including the Withdrawal, Refunds & Cancellations Policy.

 

 

1.2 Payment Flexibility vs Enrolment Commitment

 

EVO Football may offer term-by-term or instalment payment options for flexibility.

 

This flexibility:

  • Does not change the enrolment commitment

  • Does not make the program term-by-term

  • Does not guarantee continuation if a player withdraws mid-program
     

Payment structure and enrolment duration are treated separately.

 

1.3 Term Only Requests

 

If a family can only commit to a term or a shorter period of time, this must be communicated before enrolment.

 

Term-only participation:

  • Is not guaranteed

  • Is subject to availability and coach discretion
     

This ensures fairness for families committed to the full program.

 

 

1.4 Enrolment Status

 

EVO Football memberships are not ongoing.

 

A new Expression of Interest (EOI) must be submitted each season. Offers are issued at EVO Football’s discretion and subject to availability.

 

 

1.5 Late Commencement

 

Players commencing after the start of Term 1 may have fees pro-rated based on remaining weeks in the season.

 

 

1.6 Sibling Discount

 

A 10% sibling discount applies to siblings enrolled in the same season and is applied at enrolment.

2. ATTENDANCE & BEHAVIOUR EXPECTATIONS

 

2.1 Attendance Expectations

 

Regular attendance is an important part of EVO Football's long-term player development model and contributes to the quality, progression and consistency of the program.

 

Players are expected to attend all scheduled training sessions within their enrolled program wherever reasonably possible.

Enrolment is for participation in the overall development program rather than payment for individual training sessions. Accordingly, missed sessions do not reduce or alter the enrolment fees payable.

 

 

2.2 Communication of Absences

 

Where a player is unable to attend a scheduled session, parents/guardians should notify EVO Football Administration as soon as reasonably practicable.

Notification assists EVO Football in managing attendance and, where reasonably practicable, considering a make-up session in accordance with Section 3.

Notification of an absence does not create an entitlement to a make-up session, refund or training credit.

Absences must be communicated to EVO Football Administration by email before or within 48 hours of the missed session:

Requests for make-up sessions must also be managed through EVO Football Administration via email.

 

 

2.3 Attendance Review & Player Welfare 

 

Where a player has missed three (3) or more scheduled sessions without medical certification or prior communication, EVO Football may review the player's ongoing enrolment to ensure the program remains appropriate.

 

This review is intended to consider:

  • Player welfare;

  • Training load;

  • Commitment to the program; and

  • Overall suitability of the enrolment.

 

This process is developmental rather than disciplinary.

3. SESSION MAKE-UPS, CREDITS & ROLLOVERS

 

3.1 Attendance Expectations

 

Regular attendance is essential to maximise player development and ensure the quality and consistency of the EVO Football program.

Players are expected to attend all scheduled training sessions within their enrolled program. Where a player is unable to attend a scheduled session, EVO Football encourages families to notify the administration team as early as reasonably practicable.

Missed sessions do not reduce or alter the enrolment fees payable.

 

 

3.2 Player Absences & Make-Up Sessions

Where a player is unable to attend a scheduled training session due to illness, injury, holidays, school commitments, work commitments, representative football or any other personal circumstance, EVO Football may permit the player to attend a make-up session.

Make-up sessions are provided as an additional training opportunity rather than a monetary credit.

Make-up sessions:

  • Are provided as a courtesy by EVO Football and are not guaranteed.

  • Must be completed within the same school term as the missed session unless otherwise approved by EVO Football.

  • Must be within the player’s enrolled program and age group unless otherwise approved.

  • Are subject to coach approval, session capacity and operational requirements.

  • May only be attended at an EVO Football approved session.

  • Must be arranged and confirmed through EVO Football Administration prior to attendance.

  • Are for the registered player and are non-transferable unless otherwise approved by EVO Football.

  • Have no cash or monetary value.

  • Cannot be exchanged for a refund or training credit.

  • Cannot be deducted from current or future enrolment fees.

  • Cannot be applied towards camps, tours, kit or any other EVO Football program, product or service.

Where a suitable make-up session is not reasonably available within the same school term, the missed session will lapse and is not eligible for a refund or credit, except as provided in Sections 3.5 and 3.7.

Player absences are not eligible for refunds, credits or transfer to future terms except as outlined in Sections 3.5 and 3.7.

3.3 Exception - EVO-Cancelled Sessions

Where EVO Football is unable to deliver a scheduled training session due to circumstances within its reasonable control, EVO Football will determine an appropriate remedy.

Examples may include, but are not limited to:

  • A coach failing to attend where no suitable replacement can be arranged.

  • An administrative or operational error preventing the session from proceeding.

  • A venue becoming unavailable due to an error or oversight by EVO Football.

  • Any other circumstance where EVO Football is responsible for being unable to provide the scheduled service.

 

Where reasonably practicable, EVO Football will first seek to provide:

  • An approved make-up session;

  • Attendance at an equivalent session at another time or location; or

  • Another reasonable alternative determined by EVO Football.

 

Training credits are not automatically provided and will only be considered where EVO Football has been unable to deliver the service and no reasonable alternative can be offered.

EVO Football will determine an appropriate remedy, acting reasonably and having regard to the circumstances, the nature of the cancelled session, and the availability of suitable alternatives.

3.4 Force Majeure

From time to time, training may be cancelled or modified due to circumstances outside EVO Football's reasonable control.

 

These may include, but are not limited to:

  • Severe weather;

  • Extreme heat, lightning or hazardous air quality;

  • Flooding or natural disasters;

  • Government directions or public health restrictions;

  • Power outages;

  • Facility closures or restrictions imposed by venue providers;

  • Emergency incidents; or

  • Any other force majeure event.

 

Where a session is cancelled due to circumstances beyond EVO Football's reasonable control, participants are not ordinarily entitled to a refund, credit or replacement session. However, EVO Football may, acting reasonably and having regard to the duration and impact of the disruption, offer an alternative training opportunity, replacement session, credit or other appropriate remedy where practicable.

3.5 Long-Term Injury or Medical Incapacity

EVO Football understands that serious injuries and unforeseen medical conditions can occasionally prevent a player from participating for an extended period.

Where a player is medically unable to participate in football activities for a prolonged period, EVO Football may consider a Medical Suspension.

To be eligible, the following requirements must be met:

  • The player must be unable to participate for a minimum of six (6) consecutive weeks.

  • A medical certificate from the treating doctor or specialist confirming the player's inability to participate must be provided.

  • The request must be submitted as soon as reasonably practicable after the injury or diagnosis.

  • The missed sessions cannot reasonably be accommodated through approved make-up sessions.

 

Where approved, EVO Football, may, acting reasonably and having regard to the circumstances:

  • Suspend the player's remaining enrolment;

  • Extend the remaining value of the enrolment into a future term;

  • Apply a partial training credit towards a future enrolment; or

  • Determine another reasonable solution.

 

Refunds will not ordinarily be provided except where required under Australian Consumer Law.

Short-term injuries and illnesses that can reasonably be accommodated through make-up sessions are not eligible for Medical Suspension.

3.6 Session Delivery

Minor operational changes do not constitute a cancelled training session.

EVO Football may, where reasonably necessary:

  • Change coaches or coaching staff;

  • Combine training groups;

  • Modify training activities or session format;

  • Relocate training within a venue or to an alternative venue; or

  • Make other reasonable operational adjustments,

provided a meaningful training session is delivered.

Such changes do not entitle participants to refunds, make-up sessions or training credits.

3.7 Training Credits 

Training credits are exceptional and are only issued where EVO Football considers it appropriate, acting reasonably and in accordance with these Terms.

 

Where issued:

  • Credits are valid only towards future EVO Football enrolments.

  • Credits cannot be exchanged for cash or refunded.

  • Credits are non-transferable unless approved by EVO Football.

  • Credits must be redeemed within the validity period specified by EVO Football at the time of issue.

  • Expired credits will not be reinstated.

 

No person, coach or staff member other than EVO Football management may approve or guarantee a training credit.

4. TRAINING ALLOCATION & SCHEDULING

 

4.1 Allocation Authority

 

Training days, times, formats (field, gym, morning sessions), team placement, and group allocation are determined solely by EVO Football based on:

  • Program structure

  • Age group

  • Coach capacity

  • Facility availability

  • Overall training balance
     

Availability submitted during enrolment informs scheduling but does not guarantee specific sessions.

 

4.2 Gym Sessions

 

Gym sessions:

  • Have limited capacity

  • Are allocated on a first in, best dressed basis

  • Are subject to additional attendance requirements
     

If a player misses two consecutive allocated gym sessions without medical certification, their gym place may be reallocated.

 

Notifying EVO of absence remains mandatory at all times.

 

4.3 Missed Sessions

Missed sessions must be reported in accordance with Section 2.2.

Reporting an absence does not automatically create an entitlement to a make-up session, refund or training credit.

 

 

4.4 Make-Up Sessions

Eligible reported missed sessions may be made up:

• Within the player’s enrolled program and appropriate age group unless otherwise approved by EVO Football;
• Subject to coach approval, session availability, capacity and operational requirements;
• Within the same school term as the missed session unless otherwise approved by EVO Football; and
• By prior arrangement with EVO Football Administration at info@evofootball.com.au.

Families must receive confirmation from EVO Football Administration before attending a make-up session.

A make-up session is an additional training opportunity only and has no monetary value. Make-up sessions cannot be converted into a refund or credit, deducted from current or future fees or applied towards camps, tours, kit or other EVO Football programs, products or services.

 

 

4.5 Unreported Sessions

Sessions missed without notification in accordance with Section 2.2 are not eligible for make-up sessions or training credits.

Repeated absences, even when communicated, do not create an entitlement to ongoing make-up sessions or credits.

5 CANCELLED SESSIONS (WEATHER/SAFETY)

 

Cancelled sessions, weather-related disruptions, facility closures, force majeure events, make-up sessions and any applicable remedies are governed by Section 3 – Session Attendance, Make-Up Sessions, Medical Absences & Cancelled Sessions.

6 FEES & PAYMENT METHODS

 

6.1 Payment Options

 

Fees may be paid:

  • In full (cash, bank transfer, or payment link), or

  • Via an authorised instalment plan (credit card only)
     

Bank transfers are not accepted for instalment plans.

 

 

6.2 Re-Quoting & Program Changes

 

EVO Football reserves the right to re-quote fees where:

  • program structure changes

  • external supplier costs change

  • additional services are requested
     

Any re-quote will be communicated prior to confirmation.

 

 

6.3 Instalment Plan Completion

 

All instalment plans:

  • Must be paid in full within the enrolment period

  • Do not extend beyond the program duration

  • Any outstanding balance becomes immediately payable at program end

7 CREDITS & CREDIT POLICY

7.1 Purpose

Training credits are exceptional and are not an automatic entitlement.

Credits may only be issued where expressly provided for under these Terms or where EVO Football Management determines, acting reasonably, that a credit is an appropriate resolution.

A make-up session provided for a player absence under Section 3.2 is not a training credit, does not represent the monetary value of the missed session and has no cash value.

7.2 When Credits May Be Issued

Training credits may be considered in circumstances including:

• Approved Medical Suspensions;
• Exceptional operational circumstances;
• Circumstances where EVO Football is unable to provide a service and a reasonable alternative cannot be offered; or
• Other exceptional situations approved by EVO Football Management.

Training credits are not automatically issued in any of these circumstances and will be assessed in accordance with these Terms.

7.3 Credits Will Not Normally Be Issued For

Training credits will not normally be issued for:

• Player illness;
• Short-term injury;
• Holidays;
• School commitments;
• Work commitments;
• Representative football;
• Club football;
• Personal scheduling conflicts;
• Weather cancellations; or
• Force majeure events,

unless otherwise expressly provided under these Terms.

Where eligible, ordinary player absences will instead be managed through the make-up session provisions in Section 3.

The inability or failure to attend an offered make-up session does not create an entitlement to a training credit or refund.

7.4 Credit Conditions

Where a training credit is approved:

• Credits may only be used towards the EVO Football service or enrolment specified at the time the credit is issued;
• Credits are not redeemable or refundable for cash;
• Credits cannot be applied retrospectively;
• Credits must be redeemed before their stated expiry date;
• Credits are not transferable except where approved by EVO Football Management; and
• The issue of a credit in one circumstance does not create an entitlement or precedent for future circumstances.

Only EVO Football Management may approve or guarantee a training credit.

Nothing in this section excludes, restricts or modifies any rights or remedies available under Australian Consumer Law.

8 INSTALMENT PLANS & SUBSCRIPTION MAINTENANCE FEE

 

8.1 Instalment plans are offered in good faith.

 

 

8.2 Instalment plans cannot be amended once authorised.

 

 

8.3 Instalment payments continue during school holiday periods and are not paused or deferred. Payments will recur at the frequency and on the dates agreed at the time of enrolment, regardless of term dates or holiday breaks.

 

 

8.4 Instalment plans are calculated using a monthly or fortnightly payment frequency to ensure that the full program fee is paid within the enrolment period. Instalment plans do not extend beyond the enrolment dates, regardless of payment frequency.

 

 

8.5 Subscription Maintenance Fee

 

A $100 subscription maintenance fee applies to instalment plans to cover administrative costs associated with payment recovery and management.

  • $25 is non-refundable

  • $75 is conditionally creditable

 

 

8.6 Where a subscription runs for the full agreed term without any payment defaults, $75 from the subscription maintenance fee will be credited back to the account at the conclusion of the subscription period.

 

 

8.7 The fee is not refundable in cash

 

 

8.8 If a subscription defaults or cancelled early, or requires manual intervention due to failed payments, the maintenance fee will not be credited.

 

 

8.9 Updating an expired or replaced card does not affect eligibility for the administration fee refund.

 

 

8.10 Credits are subject to EVO Football’s Credit Policy (see item 7)

8.11 Instalment payments continue irrespective of individual player attendance and are not reduced by missed sessions.

9 WITHDRAWAL, REFUNDS & CANCELLATIONS

9.1 Cooling-Off Period (48 hours)

 

A forty-eight (48) hour cooling-off period applies from the time of initial enrolment and payment.

 

If a cancellation request is submitted in writing within this 48-hour period:

  • A full refund will be issued; and

  • Any associated instalment plan will be cancelled.
     

The cooling-off period applies only to new enrolments and does not apply:

  • After the commencement of the player’s first session;

  • To deposits securing future season positions; or

  • Where services have already been accessed.
     

 

9.2 Invite-Only Enrolment

 

EVO Football programs are offered on an invite-only basis.

 

An offer secures the opportunity to enrol for the stated season only and does not guarantee ongoing placement beyond the confirmed enrolment period.


 

9.3 Deposit Payments (Future Season Securing)

 

Deposits are required only where a family elects to secure a position in a future season or program year prior to its commencement.

 

Deposits:

  • Secure the offered position for the upcoming season;

  • Are applied toward the total program fee;

  • Are not an additional charge.
     

Where a program has already commenced, no deposit is required and enrolment proceeds in accordance with standard payment terms.

​Once the program has commenced, any deposit paid is automatically applied as fees toward the enrolment and is no longer treated as a deposit. From this point, all standard fee, instalment, and withdrawal terms apply.


 

9.4 Deposit Refund Conditions

 

Deposits paid to secure a future season position are generally non-refundable, as they reserve a limited invite-only position that cannot be offered to another player.

 

Where deposits are collected prior to final training schedules being released, the confirmed schedule will be provided prior to commencement of the season.

 

If, upon release of the final schedule, a player is genuinely unable to attend due to a timetable clash that could not reasonably have been identified earlier, families may withdraw within five (5) business days of the schedule being issued and receive a refund of the deposit.

 

Once the season has commenced, deposits become non-refundable except where required under Australian Consumer Law.


 

9.5 Term 1 Withdrawal (Early Season Provision)

 

Players may withdraw from the program up to the end of Week 5 of Term 1.

 

In these circumstances:

  • Instalment payments will cease; and

  • Any difference between fees paid and sessions delivered will be refunded.
     

After Week 5 of Term 1:

  • Fees for the remainder of Term 1 remain payable; and

  • Any credit issued following withdrawal will be determined in accordance with Sections 3 and 7 of these Terms.

This provision is intended to provide flexibility early in the season while maintaining program stability.


 

9.6 Term 2 & Term 3 Withdrawal

 

From the commencement of Term 2 onward, enrolment is committed for the full term due to:

  • Fixed coaching allocations;

  • Facility bookings;

  • Squad and group planning;

  • Limited invite-only capacity.
     

Where a withdrawal occurs during Term 2 or Term 3:

  • Fees for the remainder of the current term remain payable; and

  • EVO Football may, at its discretion, issue a credit for unused sessions in accordance with its Credit Policy.
     

Refunds are not provided for change of mind or scheduling preferences once a term has commenced.


 

9.7 Notice of Withdrawal

 

A minimum of two (2) weeks’ written notice is required for any withdrawal.

 

Notice must be submitted to EVO Football Administration in writing.


 

9.8 Academy-Club Offer – External Club Deposit Consideration

 

Players who are offered an Academy-Club position with EVO Football and have already paid a deposit to another club may submit a written request for partial reimbursement.

 

EVO Football may, at its sole discretion, approve a refund or credit of up to 50% of the external club deposit.

 

Approval is:

  • Assessed on a case-by-case basis;

  • Subject to proof of payment to the external club;

  • Not guaranteed and does not create a precedent.
     

Any approved amount will be issued as a credit, unless otherwise confirmed in writing by EVO Football.

 

Requests must be submitted:

  • Prior to the commencement of the season; or

  • Within a timeframe specified by EVO Football.
     

 

9.9 Credits

 

Any credits issued:

  • Are not redeemable for cash;

  • Must be used within the stated validity period;

  • Are governed by EVO Football’s Credit Policy (see Section 7)
     

 

9.10 Australian Consumer Law

 

Nothing in this policy excludes, restricts, or modifies any rights or remedies available under the Australian Consumer Law.

 

Where a service has a major failure or does not comply with a statutory consumer guarantee, remedies will be provided in accordance with the Competition and Consumer Act 2010 (Cth).

10 KIT REQUIREMENTS

10. 1 The EVO Training Kit is mandatory for all players.

  • Kits with the green FET logo are no longer valid

  • Returning players with white EVO logo kit do not need to repurchase shorts/socks

  • Kits may only be exchanged if unworn, unwashed, and tagged

  • Reorders may take up to four (4) weeks
     

 

10.2 Replacement Kit

 

Replacement kit items may be purchased at a discounted rate of:

 

10.3 Discounted replacement pricing applies to replacement items only and does not apply to initial kit purchases.

11 CONDUCT, SELECTION & ELIGIBILITY (CODE OF CONDUCT)

11.1 Player selection for matches and squads is based on performance, attitude, effort, and developmental needs, not friendships or external preferences.

 

 

11.2 EVO Football aims to provide balanced opportunities across squads where appropriate; however, selection decisions remain at the sole discretion of EVO coaching staff.

 

 

11.3 Age Group eligibility is determined by birth year. 

 

 

11.4 Breaches of the EVO Code of Conduct may result in suspension or removal from programs without refund.

 

 

11.5 Age Group Movement

 

Movement into an older age group may only occur with approval from EVO coaching staff. No parent request, external recommendation, or comparative argument overrides this authority.

 

 

11.6 Public Commentary & Misrepresentation

 

Public commentary that misrepresents EVO Football, its programs, or its staff, including commentary made on social media platforms, online review forums, or public discussion channels, and which continues after prior written warnings, may result in termination of participation.

 

 

11.7 Affiliate Membership & Friday Night Match Participation

 

Participation in Friday night affiliate matches is a privilege, not an entitlement.

 

Affiliate match involvement is offered to players who demonstrate consistent attendance, commitment, and alignment with EVO Football’s behavioural and development standards.

 

If a player misses two (2) Friday night affiliate matches without medical certification or prior approval from EVO Football Administration, the player’s affiliate membership will be reviewed.

 

This review may result in:

  • Continued participation with conditions

  • Temporary suspension from affiliate matches

  • Removal from the affiliate match program

 

This review process is not disciplinary. Its purpose is to ensure the integrity, commitment standards, and operational viability of the affiliate program.

12 TOURS, CAMPS & SPECIAL PROGRAMS

12.1 Separate Terms Apply

 

Tours, camps, interstate, and international programs are subject to separate terms and conditions, which may include but are not limited to:

  • Non-refundable deposits

  • Third-party supplier terms and conditions

  • Minimum participation numbers

  • Fixed payment schedules
     

By registering for a tour or special program, families acknowledge and accept that these terms operate in addition to EVO Football’s general Terms & Conditions.

 

 

12.2 Tour Payments, Refunds & Third-Party Suppliers

 

Tour payments, including deposits and instalments, are generally non-refundable once paid to a tour operator or third-party supplier.

 

EVO Football acts as an intermediary only and is not the provider of flights, accommodation, transport, venues, or other third-party services.

 

Accordingly:

  • EVO Football cannot recover or refund amounts already remitted to tour operators, airlines, accommodation providers, or other third-party suppliers

  • Any refund, credit, or reimbursement is strictly subject to the terms and conditions of the relevant third-party supplier, not EVO Football
    Where EVO Football receives a refund or credit from a third-party supplier, this will be passed on to the payee less any non-recoverable costs already incurred
     

Parents/guardians acknowledge that:

  • Tour pricing is based on minimum participation numbers and fixed supplier commitments

  • Withdrawals may impact the viability and cost structure of the tour

  • A player’s withdrawal does not entitle the family to a refund from EVO Football where costs have already been incurred

 

 

12.3 Changes, Cancellations & Liability

 

EVO Football is not liable for changes, cancellations, delays, or additional costs imposed by third-party providers, including but not limited to:

  • Airlines

  • Accommodation providers

  • Transport operators

  • Venues

  • Tour organisers
     

Where changes occur, EVO Football will communicate updates as soon as practicable but is not responsible for losses or expenses arising from third-party decisions.

12.4 Tour Deposits

 

Tour deposits secure a player’s place within the touring squad and enable EVO Football to confirm bookings and commitments with accommodation providers, transport operators, tournament organisers and other third-party suppliers.

Unless otherwise stated in writing, tour deposits are non-refundable once paid, except where required under Australian Consumer Law.

Where a player withdraws after paying a deposit, EVO Football may, at its sole discretion, transfer the deposit to another EVO Football program or provide a partial refund only where the position can be filled, and no non-recoverable costs have been incurred. EVO Football is under no obligation to do so.

13 MEDIA, MEDICAL & LIABILITY

By enrolling:

  • Consent is given for photo/video use when in a group setting

  • Parents confirm the player is medically fit to participate

  • All pre-existing medical conditions must be disclosed

14 FORCE MAJEURE

14.1 EVO Football shall not be liable for failure or delay in providing services due to events beyond reasonable control, including but not limited to:

  • extreme weather

  • natural disasters

  • pandemics

  • government restrictions

  • facility closures

  • industrial action

14.2 Affected services may be rescheduled, credited, or adjusted at EVO Football’s discretion.

15 LOST PROPERTY

15.1 Lost property is collected and stored throughout the term.

 

15.2 Any unclaimed items remaining at the end of each term may be donated, recycled, or repurposed at EVO Football’s discretion.

16 PHYSIOTHERAPY SERVICES

16.1 Independent Contractor Relationship

 

Physiotherapy services made available through EVO Football are provided by a sports physiotherapist operating as an independent contractor.

The physiotherapist:

  • Is not an employee, agent, or representative of EVO Football

  • Operates their own professional practice

  • Is solely responsible for all clinical decisions, assessments, advice, treatment, and outcomes
     

EVO Football facilitates access to physiotherapy services for player convenience only and does not provide medical or clinical treatment.

 

 

16.2 Scope of Physiotherapy Services

 

Physiotherapy services may include, but are not limited to:

  • Injury assessment and screening

  • Rehabilitation programming

  • Load management advice

  • Injury prevention strategies

  • Return-to-play recommendations
     

Physiotherapy services are separate from EVO Football training programs and are not included in standard training fees unless explicitly stated in writing.

 

 

16.3 Medical Responsibility & Disclosure

 

Parents/guardians are responsible for ensuring that:

  • The player is medically fit to participate in physiotherapy services

  • All relevant medical history, diagnoses, injuries, and treatments are fully disclosed to the physiotherapist
     

Failure to disclose relevant information may impact treatment accuracy and outcomes and is not the responsibility of EVO Football.

 

 

16.4 Return-to-Training & Return-to-Play Decisions

Physiotherapy advice is advisory in nature.

 

Final decisions regarding:

  • Training participation

  • Training modification

  • Match availability

  • Training load within EVO Football programs

remain at the sole discretion of EVO Football coaching and performance staff.

 

Clearance or recommendations provided by a physiotherapist do not automatically guarantee:

  • Immediate return to full training

  • Match selection

  • Restoration of prior training load
     

All decisions are made in the context of overall player welfare, program structure, and squad integrity.

 

 

16.5 Liability & Risk Acknowledgement

 

Participation in physiotherapy services involves inherent physical risks.

EVO Football:

  • Does not assume responsibility for physiotherapy diagnosis, treatment, or clinical outcomes

  • Is not liable for injury, aggravation, or consequences arising from physiotherapy services
     

Any claims, concerns, or disputes relating to physiotherapy treatment must be directed solely to the physiotherapist and/or their professional indemnity insurer.

 

16.6 Fees, Cancellations & Missed Appointments

 

Physiotherapy fees:

  • Are set by the physiotherapist

  • Are payable directly to the physiotherapist (or as otherwise advised)
     

EVO Football:

  • Does not control physiotherapy pricing

  • Does not manage rebates or insurance claims
     

Cancellation, rescheduling, and no-show policies are determined by the physiotherapist and may include late-cancellation or missed-appointment fees.

 

16.7 Insurance & Rebates

Parents/guardians are responsible for:

  • Confirming eligibility for private health or insurance rebates

  • Managing and submitting any applicable claims
     

EVO Football does not process, guarantee, or manage physiotherapy rebates or insurance claims.

 

16.8 Information Sharing & Confidentiality

 

With parental consent, the physiotherapist may share high-level, relevant information with EVO Football coaching or performance staff for the purpose of:

  • Load management

  • Training modification

  • Player welfare
     

Detailed clinical notes remain confidential and are not shared unless explicitly authorised by the parent/guardian.

 

16.9 No Impact on EVO Fees, Credits, or Policies

 

Participation in physiotherapy services does not:

  • Alter EVO Football training fees

  • Create entitlement to refunds or credits

  • Override attendance, credit, or withdrawal policies

  • Guarantee program continuation or selection
     

Medical recommendations may inform training decisions but do not override EVO Football’s Terms of Service.

17 EVO PREMIER LEAGUE (EPL) - PROGRAM SPECIFIC TERMS

17.1 Program Overview

 

The Evolution Premier League (EPL) is a high-performance competition stream within EVO Football.

 

EPL participation is:

  • Selective

  • Standards-based

  • Not guaranteed year to year

  • Not an entitlement tied to training enrolment
     

EPL places are offered at the sole discretion of EVO Football based on performance, attitude, availability, and program needs.

 

17.2 Training Commitment & Eligibility

 

To remain eligible for EPL match participation, players must:

  • Attend their allocated EPL team training sessions

  • Maintain consistent attendance and punctuality

  • Demonstrate commitment to team standards and preparation
     

Failure to meet EPL training expectations may result in:

  • Reduced match involvement

  • Temporary non-selection

  • Removal from EPL participation
     

This is a performance and commitment decision, not a disciplinary one.

 

17.3 Training Allocation

 

EPL training groups, days, and teams are:

  • Allocated by EVO Football

  • Based on squad balance, coaching structure, and player development needs

  • Not selected by parents or guardians
     

Requests to change EPL training days or teams will only be considered for genuine reasons and must be submitted to Administration. Approval is not guaranteed.

 

17.4 Match Selection & Playing Time

 

EPL match selection and playing time are determined by EVO Football coaching staff based on:

  • Performance in training and matches

  • Tactical requirements

  • Player welfare and load management

  • Long-term development considerations
     

EVO Football aims to provide appropriate developmental opportunities across the squad; however:

  • Equal playing time is not guaranteed

  • Selection decisions are not negotiable

  • Match minutes are not a contractual entitlement
     

 

17.5 Missed Matches

 

Players are expected to be available for scheduled EPL fixtures.

 

If a player is unavailable:

  • Notice must be provided as early as possible

  • Availability decisions may impact future selection
     

Repeated unavailability may result in EPL participation being reviewed.

 

17.6 Train-On Players

 

Train-On players may:

  • Be allocated to EPL training groups for development purposes

  • Be invited to participate in EPL matches as replacement players or for specific development opportunities
     

Match involvement for Train-On players is not guaranteed and remains at coach discretion.

 

17.7 Behaviour & Conduct (EPL Context)

 

EPL players and families are expected to uphold:

  • EVO Football’s Code of Conduct

  • Respect toward teammates, opponents, officials, and staff

  • Appropriate sideline and spectator behaviour
     

Breaches may result in:

  • Match suspension

  • Removal from EPL squads

  • Termination of EPL participation
     

These decisions may be made independently of broader academy enrolment.

 

17.8 EPL Is a Privilege

Participation in the Evolution Premier League is a privilege, not an entitlement.

EVO Football reserves the right to:

  • Review EPL participation at any time

  • Adjust squad composition

Remove players whose commitment, behaviour, or availability no longer aligns with EPL standards.

18 HIGH PERFORMANCE PATHWAY (HPP) - PROGRAM SPECIFIC TERMS

18.1 Program Overview

 

The High Performance Pathway (HPP) is an invite-only development stream within EVO Football.

 

HPP participation:

  • Is selective

  • Is based on standards, behaviours, and performance

  • Is not guaranteed year to year

  • Does not replace club, academy, or external commitments unless explicitly agreed in writing
     

HPP places are offered at the sole discretion of EVO Football.

 

18.2 Selection & Review

 

Selection into HPP is based on:

  • Training habits and consistency

  • Coachability and mindset

  • Technical and tactical development

  • Physical readiness and load tolerance

  • Alignment with EVO’s values and standards
     

HPP participation is continuously reviewed and may be adjusted, paused, or withdrawn if standards are not maintained.

 

18.3 Commitment & Expectations

 

HPP players are expected to:

  • Prioritise HPP sessions where scheduled

  • Maintain high attendance standards

  • Engage professionally with feedback and review processes

  • Demonstrate leadership and accountability
     

Failure to meet HPP expectations may result in:

  • Modified involvement

  • Temporary suspension from HPP activities

  • Removal from the HPP program
     

This process is not disciplinary and does not affect standard academy enrolment unless otherwise stated.

 

18.4 Load Management & Welfare

 

HPP operates with an emphasis on long-term athlete development.

EVO Football may:

  • Modify training loads

  • Restrict match exposure

  • Recommend rest or external medical support

to protect player welfare.

 

HPP participation does not override medical advice, club obligations, or EVO Football’s duty of care.

 

18.5 No Guarantee of Outcomes

 

Participation in the High Performance Pathway:

  • Does not guarantee selection into EPL, senior squads, or representative teams

  • Does not guarantee trials, contracts, scholarships, or professional opportunities

  • Does not guarantee exposure to scouts, clubs, or agents
     

HPP is a development opportunity, not a promise of advancement.

 

18.6 Fees & Program Structure

 

HPP fees, where applicable:

  • Are separate from standard academy fees

  • Will be communicated in writing

  • Are subject to the same payment, attendance, and withdrawal policies outlined in these Terms & Conditions

19 PLAYER REPRESENTATION & PATHWAY SUPPORT

19.1 Nature of Representation

 

Where EVO Football provides player representation, pathway support, or introductions to clubs, scouts, agents, or external programs, this support is developmental and advisory in nature.

 

EVO Football:

  • Is not a licensed player agent unless explicitly stated in writing

  • Does not act as the player’s exclusive representative unless a separate agreement exists

  • Does not negotiate contracts on behalf of players unless separately contracted to do so
     

 

19.2 Pathway Support Activities

 

Player representation and pathway support may include:

  • Guidance on trials and opportunities

  • Introductions to clubs or programs

  • Advice on player presentation and preparation

  • Feedback on pathway decisions
     

The nature and extent of support varies by player and is not uniform or guaranteed.

19.3 No Guarantee of Selection or Contracts

 

Player representation or pathway support:

  • Does not guarantee trials, selection, contracts, scholarships, visas, or professional outcomes

  • Does not guarantee ongoing support if standards are not maintained
     

All external decisions remain at the sole discretion of third-party clubs, organisations, or agents.

19.4 Player Responsibility & Conduct

 

Players receiving pathway or representation support are expected to:

  • Act professionally at all times

  • Communicate honestly and promptly

  • Represent EVO Football appropriately in external environments
     

Misconduct, misrepresentation, or behaviour that damages EVO Football’s credibility may result in:

  • Withdrawal of representation support

  • Termination of pathway involvement
     

 

19.5 Conflicts of Interest

 

EVO Football reserves the right to:

  • Decline representation where conflicts of interest exist

  • Withdraw support if a player engages separate representation without disclosure

  • Adjust involvement if alignment or trust is compromised
     

 

19.6 Fees & Separate Agreements

 

Any fees associated with player representation or pathway support:

  • Will be outlined in writing

  • May be governed by separate agreements

  • Are not refundable unless expressly stated
     

Where a separate agreement exists, that agreement prevails over this section in the event of inconsistency.

 

 

19.7 Termination of Support

 

EVO Football may withdraw representation or pathway support at any time if:

  • Player standards are not maintained

  • Behaviour undermines trust or credibility

  • Program alignment no longer exists
     

Withdrawal of representation support does not entitle the player to refunds, compensation, or alternative services.

​20 GOVERNING LAW & AMENDMENTS

 

These terms are governed by the laws of Western Australia and may be updated from time to time.
